Thank you for your interest in the Tiny Sangha Project (also referred to as “TSP”). Please read these Terms of Service carefully. They govern your use of the website and your engagement with all other aspects of the Tiny Sangha Project. To make this agreement easier to read, the website and other Tiny Sangha Project services will be referred to as “Services” and the Terms of Service agreement will be referred to as “Terms.”

These Terms and conditions apply to the TSP website and to your participation in our events and activities or any related products and services. You may be bound by additional contracts or agreements related to your relationship with us or any products, services or events related to TSP. If any provisions of the additional contracts conflict with any provisions of these Terms, the provisions of these additional contracts will control and prevail.

Agreement to the Terms

By using our Services, you agree to be bound by these Terms. If you do not agree to be bound by the below Terms, do not use Tiny Sangha Project Services.

Who May Use the Services

You may visit the website if you are 13 years or older unless applicable law dictates otherwise. But to join a Tiny Sangha Project meditation group, you must be 18 years or older and capable of agreeing to a binding contract. The Tiny Sangha Project creates protected spaces for Black/African American people interested in learning to practice mindfulness meditation. If you are not of Black/African American heritage and/or you are not interested in learning to practice mindfulness meditation, do not use the Services.  

Binding

By registering with, accessing, or otherwise using this website, you hereby agree to be bound by the Terms and Conditions set forth below. The mere use of this website implies the knowledge and acceptance of these Terms and conditions. In some particular cases, we can also ask you to explicitly agree.

Electronic communication

By using this website or communicating with us by electronic means, you agree and acknowledge that we may communicate with you electronically on our website or by sending an email to you, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement, including but not limited to the requirement that such communications should be in writing.

Intellectual property

We or our licensors own and control all of the copyright and other intellectual property rights in the website and the data, information, and other resources displayed by or accessible within the website.

Unless specific content dictates otherwise, you are not granted a license or any other right under Copyright, Trademark, Patent, or other Intellectual Property Rights. This means that you will not use, copy, reproduce, perform, display, distribute, embed into any electronic medium, alter, reverse engineer, decompile, transfer, download, transmit, monetize, sell, market, or commercialize any resources on this website in any form, without our prior written permission, except and only insofar as otherwise stipulated in regulations of mandatory law (such as the right to quote).

Our website may include hyperlinks or other references to other party’s websites. We do not monitor or review the content of other party’s websites which are linked to from this website. Products or services offered by other websites shall be subject to the applicable Terms and Conditions of those third parties. Opinions expressed or material appearing on those websites are not necessarily shared or endorsed by us.

We will not be responsible for any privacy practices or content of these sites. You bear all risks associated with the use of these websites and any related third-party services. We will not accept any responsibility for any loss or damage in whatever manner, however caused, resulting from your disclosure to third parties of personal information.

Responsible use

By visiting our website, you agree to use it only for the purposes intended and as permitted by these Terms, any additional contracts with us, and applicable laws, regulations, and generally accepted online practices and industry guidelines. You must not use our website or services to use, publish or distribute any material which consists of (or is linked to) malicious computer software; use data collected from our website for any direct marketing activity, or conduct any systematic or automated data collection activities on or in relation to our website.

Engaging in any activity that causes, or may cause, damage to the website or that interferes with the performance, availability, or accessibility of the website is strictly prohibited.

Idea submission

Do not submit any ideas, inventions, works of authorship, or other information that can be considered your own intellectual property that you would like to present to us unless we have first signed an agreement regarding the intellectual property or a non-disclosure agreement. If you disclose it to us absent such written agreement, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.

The TSP Application and Your Information

You must complete our online application to be eligible to join a Tiny Sangha Project group. Application data is transmitted using SSL/TLS encryption and stored on our website in accordance with our privacy policy. Tiny Sangha Project staff will review your application to determine whether you are eligible to join a group and which group would be most suitable. Your application information will be shared with your Tiny Sangha Project small-group facilitator. However, we will not share your information outside of Tiny Sangha Project staff unless refraining from sharing that information would jeopardize your safety or another’s safety or unless legally compelled to do so. These decisions will be made at the Tiny Sangha Project’s sole discretion.

It is important that you provide us with accurate, complete and up-to-date information and agree to update such information as needed. We rely on this information, particularly emergency contact information, to protect your safety and the safety of other group participants in case of emergency.

Using a Tiny Sangha Project Group

You understand that the Tiny Sangha Project mindfulness meditation experience and any information delivered via said experience may help participants manage anxiety (stress) and depression. That said, the Tiny Sangha Project does not guarantee these results for any participant. Nor does the Tiny Sangha Project claim to diagnose or assess the state of a participant’s mental or physical health. Tiny Sangha Project small group facilitators are not mental health professionals. In the event that a facilitator has training as a mental health professional, they are not acting in that capacity as a Tiny Sangha Project facilitator. Facilitators are not qualified to offer mental health advice or counseling. Tiny Sangha Project Services are not a substitute for professional medical care.

No proposed healing modality is effective for everyone. Mindfulness meditation is no exception. Our Services are not a substitute for professional medical care. Do not attempt to meditate while driving, operating heavy machinery or performing tasks that require concentration and attention. You are solely responsible for your use of Tiny Sangha Project Services.

Feedback

We welcome your feedback. You can email your comments and suggestions for improving the Tiny Sangha Project to info@tinysanghaproject.orgYou grant to us a non-exclusive, perpetual, irrevocable, and royalty-free license to use, copy and/or modify any feedback provided to us.

Prohibitions

You agree not to do any of the following:

  •   Post, upload, or publish any content that: (i) infringes or violates a third-party patent, copyright, trademark, trade secret or any other intellectual property rights or rights of privacy; (ii) encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive;
  •   Use the Tiny Sangha Project’s name, trademark, logo or other proprietary information, or the layout design of any page or form within a given page, without the Tiny Sangha Project’s express consent;     
  •   Access or otherwise use non-public areas of the website;
  •   Attempt to procure information about yourself or other participants from Tiny Sangha Project Services or from third-party contractors;
  •   Attempt to probe, scan or test the vulnerability of any Tiny Sangha Project online Services;
  •   Avoid, bypass, remove, deactivate or otherwise circumvent security measures implemented by the Tiny Sangha Project;
  •   Attempt to access or search the Services or download Collective Content from the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools, or the like) other than the software and/or search agents provided by the Tiny Sangha Project or generally available third party browsers;
  •   Send any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters, or other forms of solicitation;
  •   Use any meta tags or other hidden text or metadata utilizing a Tiny Sangha Project logo, URL, or trademark without Tiny Sangha Project’s express written consent;
  •   Use the Services for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms;
  •   Forge any part of the header information in any email or newsgroup posting, or in any way use the Services to send altered deceptive or false source-identifying information;
  •   Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Services;
  •   Interfere with, or attempt to interfere with the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;
  •   Collect or store any personally identifiable information from the Services from other users of the Services without their express permission;
  •   Impersonate or misrepresent your affiliation with any person or entity;
  •   Violate any applicable law or regulation; or
  •   Encourage or enable any other individual to do any of the foregoing.    

While we are not obligated to monitor access to or use of the Services or Content or to review or edit any Content, we have the right to do so for the purpose of operating the Services, to ensure compliance with these Terms, and to comply with applicable law or other legal requirements. We reserve the right, but are not obligated to, remove or disable access to any Content, at any time and without notice, including, but not limited to, if we at our sole discretion, consider any content to be objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or conduct that affects the Services. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.

Termination of use

We may, in our sole discretion, at any time modify or discontinue access to, temporarily or permanently, the website or any Service thereon. You agree that we will not be liable to you or any third party for any such modification, suspension or discontinuance of your access to, or use of, the website or any content that you may have shared on the website. You will not be entitled to any compensation or other payment, even if certain features, settings, and/or any Content you have contributed or have come to rely on, are permanently lost. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our website.

You may cease your participation in the Tiny Sangha Project at any time. Although you have no obligation to inform the Tiny Sangha Project of your decision to stop participating, we would greatly appreciate notification of your intention to cease participation. You can notify us by sending an email to info@tinysanghaproject.org and/or james@tinysanghaproject.org and/or to your group facilitator’s email address. 

Warranties and liability

Nothing in this section will limit or exclude any warranty implied by law that it would be unlawful to limit or to exclude. This website and all content on the website are provided on an “as is” and “as available” basis and may include inaccuracies or typographical errors. We expressly disclaim all warranties of any kind, whether express or implied, as to the availability, accuracy, or completeness of the Content. We make no warranty that:

  • this website or our content will meet your requirements;
  • this website will be available on an uninterrupted, timely, secure, or error-free basis.

Nothing on this website constitutes or is meant to constitute, legal, financial or medical advice of any kind. If you require advice you should consult an appropriate professional.

The following provisions of this section will apply to the maximum extent permitted by applicable law and will not limit or exclude our liability in respect of any matter which it would be unlawful or illegal for us to limit or to exclude our liability. Assignment

You may not assign, transfer or sub-contract any of your rights and/or obligations under these Terms and conditions, in whole or in part, to any third party without our prior written consent. Any purported assignment in violation of this Section will be null and void.

Breaches of these Terms and Conditions

Without prejudice to our other rights under these Terms and Conditions, if you breach these Terms and Conditions in any way, we may take such action as we deem appropriate to deal with the breach, including temporarily or permanently suspending your access to the website, contacting your internet service provider to request that they block your access to the website, and/or commence legal action against you.

Force majeure

Except for obligations to pay money hereunder, no delay, failure or omission by either party to carry out or observe any of its obligations hereunder will be deemed to be a breach of these Terms and conditions if and for as long as such delay, failure or omission arises from any cause beyond the reasonable control of that party.

Indemnification

You agree to indemnify, defend and hold us harmless, from and against any and all claims, liabilities, damages, losses and expenses, relating to your violation of these Terms and conditions, and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for our damages, losses, costs and expenses relating to or arising out of such claims.

Waiver

Failure to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.

Language

These Terms and Conditions will be interpreted and construed exclusively in English. All notices and correspondence will be written exclusively in that language.

Entire agreement

These Terms and Conditions, together with our privacy statement and cookie policy, constitute the entire agreement between you and The Tiny Sangha Project in relation to your use of this website.

Updating of these Terms and conditions

We may update these Terms and Conditions from time to time. It is your obligation to periodically check these Terms and Conditions for changes or updates. The date provided at the beginning of these Terms and Conditions is the latest revision date. Changes to these Terms and Conditions will become effective upon such changes being posted to this website. Your continued use of this website following the posting of changes or updates will be considered notice of your acceptance to abide by and be bound by these Terms and Conditions.

Choice of Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of Wisconsin, United States of America. Any disputes relating to these Terms and Conditions shall be subject to the jurisdiction of the courts of Madison, Wisconsin, United States. If any part or provision of these Terms and Conditions is found by a court or other authority to be invalid and/or unenforceable under applicable law, such part or provision will be modified, deleted and/or enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions. The other provisions will not be affected.

General Terms

These Terms constitute the entire and exclusive understanding and agreement between the Tiny Sangha Project and you regarding the Services, Products and Content. These Terms supersede and replace any and all prior written understandings or agreements between the Tiny Sangha Project and you regarding Services, Products and Content. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.

Any notices or other communications provided by the Tiny Sangha Project under these Terms, including those regarding modifications to these Terms, will be given by the Tiny Sangha Project via email or by posting to the Services. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

The Tiny Sangha’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of the Tiny Sangha Project.
